Can I start maternity leave before the due date in Malaysia?

You can, in fact, take maternity leave before your due date. It is imperative that you receive written confirmation that your compensation will not be reduced if you begin taking paid leave earlier than expected.

No notice time is required if it is within four weeks before or after the birth of a child. Maternity leave workers must give two weeks’ notice if they plan to leave their jobs during the remaining days of their leave (if any).

Additional written notice can be given at the conclusion of your pregnancy and/or when you return to work after Maternity Leave, if necessary. Under Section 71(a) of the Pregnancy Disability Leave Act, an employer cannot force a female employee to resign while she is on maternity leave, but she has the right to do so.
